Work Café Terms of Use

General

These terms of use apply to you as an individual using the Work Café co-working areas, meeting rooms, or attending or hosting an Event at Work Café premises (“you”), operated by Santander International through www.workcafe.im (“Website”).

By using the Work Café facilities or hosting or attending an Event, you agree to comply with these terms of use.

1. Who we are and how to contact us

In these terms of use, “we”, “us” or “our” refers to Santander International, which is the trading name of Santander Financial Services plc, Isle of Man Branch, whose principal place of business is at 19–21 Prospect Hill, Douglas, Isle of Man, IM1 1ET, and which is regulated by the Isle of Man Financial Services Authority.

2. Use of co-working area, meeting rooms and event space

You are entitled to use our co-working area, meeting rooms and (where applicable) Event space, subject to these terms of use.

2.1 You must not bring your own food or drink into the Work Café, meeting rooms or Event space. You may only consume food and drink purchased on the premises or, in the case of Events, catering arranged through our café partner, Noa.

2.2 Alcohol may only be consumed on the premises where it has been purchased from, supplied by, or expressly authorised by the Work Café or its approved café partner. You must not bring your own alcohol onto the premises. The sale and consumption of alcohol are subject to applicable licensing laws, and we reserve the right to refuse service at our discretion. All sale and consumption of alcohol is subject to applicable Isle of Man licensing legislation.

2.3 Smoking and the use of vapes are not permitted inside the Work Café or in the outside seating area.

2.4 Only assistance animals are permitted on site.

2.5 You must not use the co-working area, meeting rooms or Event space in any way that results in annoyance or disturbance to us or any visitors, or which may bring our name into disrepute.

2.6 If you intend to film any activity within the Work Café in a commercial capacity, you must seek consent from the Work Café Director. We are entitled to require any customer filming within the Work Café to stop doing so. Filming or photography cannot take place inside branches unless authorised.

3. Security & confidentiality protection

You must not film, photograph or record any banking activity, customer interaction or confidential information within the premises without prior written consent. This restriction is necessary to protect customer confidentiality, security and regulatory obligations.

4. Use of internet

You are entitled to free internet access at our premises, including during Events. Such use is at your own risk and subject to compliance at all times with the relevant provisions of the Digital Economy Act 2010.

We provide internet access through a third-party service provider. You will be asked to accept terms and conditions when you connect to the service. Please contact a member of staff if you require assistance connecting to our Wi-Fi service.

We will not be liable for any loss or damage caused by:

  • any act or omission of the third-party service provider;
  • a virus, distributed denial-of-service attack or other technologically harmful material that may infect your computer, equipment, computer programs, data or other proprietary material due to your use of the internet on our premises; or
  • a third party accessing or intercepting your internet traffic without authorisation.

 

We do not guarantee uninterrupted availability, speed or performance of internet access during Events or meetings.

5. Events

5.1 General

The Work Café may make its Event space available for community talks, seminars and similar events (“Events”).

Events may be hosted by Work Café, its partners or external organisers (“Event Host”), subject to prior approval.

We reserve the right to refuse or cancel any Event booking at our discretion, including where there is a conflict of interest.

Approval of an Event does not constitute endorsement of the Event Host, its content, views or services.

5.2 Santander Work Café responsibilities

In relation to approved Events, Santander Work Café agrees:

  • To allow you to use our Event space at the stated time, subject to these terms;
  • To publish your Event on the Santander Work Café website;
  • To publish your Event on Eventbrite, unless it is agreed that the Event is a drop-in or un-ticketed Event;
  • To issue a promotional post on social media (Facebook, Instagram or LinkedIn, as appropriate);
  • To monitor Event registrations and provide you with the option to cancel or postpone your Event if registrations fall below the agreed minimum level.

 

We do not guarantee a minimum number of attendees.

5.3 In-hours events (08:00–17:00, Monday to Friday)

In-hours Events are provided free of charge for use of the Event space, subject to approval and availability. Catering must be arranged through our café partner, Noa, and any costs are payable directly to Noa.

5.4 Out-of-hours events

Out-of-hours Events are managed by our café partner, Noa. Hire fees and catering charges may apply and are collected directly by Noa. Booking and cancellation terms are governed by Noa’s agreement.

5.5 Event host responsibilities

By hosting an Event, you agree:

  • To confirm your booking and supply all relevant Event information at least five (5) weeks prior to your Event;
  • To notify us in writing if you need to cancel or postpone your Event;
  • To ensure venue facilities and Equipment are not misused or left damaged;
  • To comply with all health and safety requirements;
  • To allow us to publish your Event on our website and social media platforms;
  • To allow us to use photographs or video recordings of your Event for promotional purposes.

 

5.6 Liability in relation to events

Our responsibility in relation to Events is limited to allowing you to use our Event space at the stated time, subject to these terms.

We shall not be liable for Event content, attendance levels, property loss, service interruption or any indirect or consequential loss.
Nothing in these terms excludes liability which cannot lawfully be excluded.

5.7 Photography, videography and personal data

Photography and videography may take place at Events for promotional and marketing purposes.

Personal data collected in connection with Events (including images, registration details and contact information) will be processed in accordance with our Privacy Policy and applicable data protection legislation, including the Isle of Man Data Protection Act 2018.

Where we arrange Event registration, we act as a data controller in respect of personal data collected for administration and promotion of the Event. Where personal data is shared with an external Event Host, the Event Host will act as an independent data controller and is responsible for its own compliance with applicable data protection laws.

We rely on our legitimate interests to promote community engagement and our services when using Event photography. You have the right to object to the processing of your personal data for these purposes. If you do not wish to appear in photography or videography, please inform a member of staff or the Event Host at the Event so that reasonable steps can be taken to accommodate your request.

5.8 Insurance

We may require Event Hosts to maintain appropriate public liability insurance in respect of their Event and to provide evidence of such insurance upon request. Event Hosts are responsible for ensuring adequate insurance cover for their activities.

6. Meeting room booking

By booking a meeting room, you represent and warrant that:

6.1 You are 18 years of age or older;

6.2 You have full legal authority to enter into these terms and conditions; and

6.3 You have read and understood these terms of use and agree to comply with them.

You are responsible for ensuring that all members of your group are aware of these terms of use and comply with them.

6.4 Meeting rooms may be booked during Work Café opening hours.

6.5 Bookings may be made for a minimum of 30 minutes and up to a maximum of two hours per day and cannot be extended beyond this period.

6.6 All bookings are subject to availability. We will send confirmation and a reminder of your booking to the email address you provide.

6.7 You are required to provide your name, email address and contact telephone number to enable us to manage the meeting room booking service effectively.

6.8 If you wish to make any changes to your booking, or no longer wish to use the meeting room, you must inform us as soon as possible.

6.9 Your booking will automatically expire if you do not record or confirm your attendance within 15 minutes of the meeting start time.

6.10 Information regarding fire evacuation procedures is available on the premises.

6.11 We reserve the right to alter proposed room layouts in order to comply with fire regulations and to refuse admission to rooms for health and safety reasons.

7. Co-working area, event space and meeting room liability

You acknowledge that facilities are provided as complimentary services without charge. We reserve the right to cancel or move bookings if required without liability to you. We will notify you if this becomes necessary.

7.1 We shall under no circumstances whatsoever be liable for:

  1. any loss of profit or revenue, loss or inaccuracy of data, equipment downtime, business interruption (in each case, whether direct or indirect) or any indirect, incidental, punitive, exemplary, special or consequential loss or damage arising under or in connection with these terms of use;
  2. any loss of or damage to property that you or others attending your meetings bring onto our premises;
  3. any loss due to mechanical breakdown, failure in electricity supply, flood, fire, government restriction, act of God or anything else outside our reasonable control which may cause the premises to be temporarily closed or your meeting to be interrupted; and
  4. any views or actions of other individuals or any actions of third parties in the Work Café.

 

7.2 You are responsible for any damage or harm caused to persons, buildings or property arising from your actions or omissions or those of your group.

7.3 Subject to clause 7.4, our total aggregate liability to you arising under or in connection with these terms of use shall not exceed £1,000 in respect of any single Event or booking

7.4 Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

8. Equipment

The use of the meeting room, Event space or co-working areas includes the hire of all equipment (“Equipment”) in the relevant space, including without limitation tables, chairs and electrical equipment, as further detailed in the relevant room or Event specification on the Website.

8.1 You must report any faulty Equipment to a member of the team as soon as possible.

8.2 You must not move Equipment from the meeting room or Event space to any other part of our premises without our consent.

8.3 If you plan to use your own laptop or computer, it must display a current PAT test label where legally required.

8.4 If you wish to bring any additional technical or electrical equipment, you must agree this with us in advance of your booking. All such equipment must display a current PAT test label where legally required.

8.5 You must not leave any equipment or property unattended. Any equipment or property brought onto the premises is at your own risk, and any loss or damage is your responsibility.

8.6 You must ensure that you leave the meeting room or Event space as you found it, removing all equipment and placing all rubbish in the bins provided.

8.7 If you damage any Equipment or any other items belonging to us whilst on the premises, you agree to pay the costs of repair or replacement.

8.8 You also agree to pay the cost of cleaning should the room or Event space be left soiled.

9. Termination and suspension

These terms of use apply to each booking and remain in full force and effect until the relevant booking has ended. We may suspend or terminate a booking and your right to book a meeting room at any time at our sole discretion, including for any violation of these terms of use.

10. How We Use Your Personal Information

Personal information collected will be used in accordance with our Privacy Policy.
